Mandatory Decision Taken Imprecisely

Whenever we sought to take a mandatory decision there are certain things that are vital to be taken care of first, a mandatory decision can only provide a precise impression when it is fully competent to do those things on which it took place. An imprecise decision can lead the whole theory to a downfall and under different circumstances an imprecise one will cause the body to be rejected by the masses, such decisions are of no use as they are compiled to deter the real issue and to seize all the time they need just to blur the truth from the eyes of those who are not aware of the situation inside Balochistan.

What was expected to be high time to take a course to end all this at once was taken lightly by the Supreme Court of Pakistan with its anachronistic Justice system and proved once again that no justice can be served until the judiciary is free from pressure of any individual or organizations will.

In the meantime the Supreme Court addressed the missing person case in an anew inquiry report which has been abjured by Voice for Baloch Missing Person (VBMP) for being totally flawed, it is worth mentioning here that it was the decision of Supreme Court to meet the families of those victims whom were abducted by the State secret agencies and were barred from any judicial inquiry, after such an immense decision to help the families out of their despair Supreme court proved its credibility among the masses but Supreme court have so far been unable to ascertain those reasons on which these missing persons were taken hostages by the Secret agencies of this obnoxious state.

For the ruling elite Baloch national rights were always been a headache, has it seems since the birth of Pakistan till date Baloch nation was deprived from every basic rights a state should provide or a nation should have, from the infrastructure to basic facilities non were given, the packages and all these schemes of development flowed when Baloch nation resisted the state powers (Military, Secret agencies) with the slogan of independent Balochistan, which led the State cardinal forces to take over Balochistan and form their own Parallel Government in which the rule and law is what the military might says, thus spilling the beans of a new military operation in the whole region of Balochistan and picking up political activists whom were seen has threat to so called "national security".

Such behavior led to the abduction and mass genocide of Baloch nation in an illegal and systemized way which was certified by the then ruler of Pakistan President Parvez Musharaf and still being supported by his successor President Asif Ali Zardari.    

Supreme Court deception over to the missing person case can be seen from the recent inquiry report in which from 8000 Baloch abducted only 72 were enlisted, this catalogue of Missing persons include many other political and Talibanic figures whom are also counted in this inquiry report and filed as missing, According to the list 8 persons are missing from Islamabad, 23 from Punjab, 15 from Sindh, 52 from Khyber Pakhtunkhawa, 72 from Balochistan and 2 from Azad Kashmir, while on the other hand the baloch organizations report missing person to be more than 8000 abducted by the secret agencies.

According to Anjuman Ittehad Marri 1086 Baloch political activists are missing from 2006 & AHRC and VBMP listed the missing person to be over 1100 whom were picked up by force and are still being held in the torture cells of Secret agencies although many Baloch political parties believe that the figure is much higher than just 1000 as some places of Balochistan are declared NO-GO areas for any human rights organizations or any NGO's and it is in these areas where there is high rate of civilian deaths and abduction.

In the thirteen session of Human Rights council a report was submitted by ALRC on February 27, 2010 in which ALRC stated "The military intelligence services have reportedly disappeared at least 168 children and 148 women since 2006 in Balochistan province alone. The ALRC has documented cases revealing that women are being disappeared and used as sex slaves by the military". It is to be mentioned that the inquiry commission report of Supreme Court doesn't specify these numbers of abducted children and women because the report is itself bogus and vague, Supreme Court has not only shunned all those facts and figures but also tried to hide the shame of their Military junta who have first used Bengali women for sex slavery now they have turned their devilish lustful desires over to Baloch nation.

The ALRC (Asian Legal Resource Centre) report stated that "According to a list compiled by the Chief Minister of Balochistan, around 1700 persons have been disappeared in the province since 2002. Most of the abductions and disappearances cases involve the country's intelligence agencies, particularly the ISI (Inter-Services Intelligence) and Military Intelligence." Such accusations on the secret agencies of this obnoxious state is not staggering because the infamous secret agencies are the ones who were solely responsible for messing around with the lives of baloch nation and are active from day one of the forceful annexation of Balochistan but still the Supreme Court have nullified such allegations as baseless they further stated that they will not examine evidence against intelligence agencies in the missing persons' case. According to the written order the Supreme Court judges profess that evidence and allegations of involvement of intelligence agencies in abducting people will be examined by an ‘appropriate forum at the relevant time.'

The relevant time will not come even after the Armageddon because the one who are been denounced by Baloch nation time by time are being coddled by the Supreme Court of Pakistan, a clear-cut scenario can be seen inside Balochistan today where the state apparatus whether they be military or secret agencies are knee-deep to harass political workers and student but still are judged as acquit. This kind of repulsive behavior by such a high hallowed court can only mean this that no law abides those who have the law in their hands and can pinch the law whenever they like.

Such decreed of the inquiry report by the Supreme Court proved the insincerity with the missing persons and their family members. One case of Zakir Majeed Baloch who was abducted on 8th June 2009 was dismissed by the Supreme Court as being out of context, the court refused to enroll the statement of Zakir Majeed Baloch relatives making an excuse that his name was not on the list of disappeared people and as per the list by NCMC (National Crisis Management Cell) Zakir Majeed was released on January 22, 2010 while the family members rejected the statement and also assailed the cell for releasing such bogus statement and playing with the feelings of Zakir Majeed's family.

In the meantime the family members of Zakir Majeed are on a hunger strike which has entered its 74th day and still no Court or Judicial inquiry commission has been able to respond over their demands and yet the Supreme Court claim's that it has succeeded to pursue the abductors to release the missing persons.

In the recent time four dead bodies of Faizullah, Najeeb Baloch, Farooq Baloch & Ashfaq Mullazai were found, From the report and list provided by VBMP these four men were abducted by secret agencies before being killed and dumped, the VBMP chairman Nasurrallah Baloch stated that "Missing persons are being killed and the list of deaths has been increasing every day, after the killing of Najeeb Langov, Faiz Baloch and Farooq Mengal there is threat to the lives of other missing people", Mind you in just three days earlier another abduction took place in which a baloch political worker Ramzan baloch was abducted by secret agencies while returning home from Karachi.

The most prominent example of missing person whose abduction was being denied by Pakistani official is the case of a Norwegian-Baloch namely Ehsan Arjemandi who was kidnapped on August 7 and was whisked away by the ISI, while later the Pakistani official stated that no such person is in their custody and in some other report the story was different the official claimed he has been extradited to Iran and the Pakistan authorities are no longer holding him, But in just recent times a new video report was produced in which Rehman Malik himself declared that Ehsan Arjemandi is in their custody and was arrested because of a fake id card, now how could Baloch nation believe in this system which is double-face and hypocrite about the Baloch issue and on the missing person's case.

The judiciary has no control and it is lifeless when it comes to the missing person's case because only a few weeks earlier a spokesman for Supreme Court Mr. Javed Iqbal asserted that "Supreme Court cannot order the release of the missing person's but it can appeal for the release." And another judge Justice Sair Ali stated that "We must be clear that if someone is not traced we will dispose of the case and say sorry" thus letting all the hopes of the families wash away with the one word.

Today Baloch nation is facing all these disregard and violations of rights but still they believe that somehow the international communities and lobbies will help them out in their struggle for survival because hope is all that bound the Baloch struggle and Secularism is the reason that it has escalated to such height. It has been 9 years since the struggle for survival commenced and in these 9 years Pakistan has gifted Baloch nation with hundreds of dead bodies and thousands of missing persons whose family members are wandering the dust and sand of Balochistan hoping that somehow their eyes will lit up once again. Baloch nation urges all those Human rights organizations, International communities, and all those freedom loving people to help heal this incision on which Balochistan was divided and Baloch national rights are clutched by these neo-colonial powers.
